In a ruling sure to make philandering spouses squirm,  
Michigan's second-highest court says that anyone involved  
in an extramarital fling can be prosecuted for first-degree  
criminal sexual conduct, a felony punishable by up to life  
in prison.  

"We cannot help but question whether the Legislature actually  
intended the result we reach here today," Judge William  
Murphy wrote in November for a unanimous Court of Appeals  
panel, "but we are curtailed by the language of the statute  
from reaching any other conclusion."  

"Technically," he added, "any time a person engages in sexual  
penetration in an adulterous relationship, he or she is  
guilty of CSC I," the most serious sexual assault charge in  
Michigan's criminal code.  

Suddenly renting the cow for the occasional milk doesn't seem  
quite as dangerous as marrying one, does it?

Given the propensity of politicians to screw around, I'm surprised they would make such a law.

What an interesting question. We all want as much freedom to do as we please. This law sort of undermines that premise. Have they gone too far in MI? I don't condone seeking carnal knowledge outside of one's union, however, I don't know all the reasons that one does such things. Because cheating could be the end of the relationship between husband and wife, what about the relationship between cheater and children? Jailing the cheater for a term of life surly puts a strain on all other relationships doesn't? Shouldn't we also consider the part that the spouse played in the desertion of the cheater from the relationship? Doesn't cheating happen out of a set of circumstances that led up to the actual night ofpassion wwith another?

Finally, is the person who the cheater is cheating with just as guilty by association? I mean if that person knew that said person was married, what makes them any better? That's it from the funny farm. Going crazy, wanna join me?

Wow. and don't forget the ocasional relationship where both know the other is not monogamous and are fine with it. This also could go into the realm of defining what marage is, a semi hot topic lately.
